HB2008 HFA Mazzocchi #1 2-2

  Delegate Mazzocchi moves to amend Com Sub for HB 2008 on page six, section seven, subsection (a), by striking out the language of subsection (a) in lines 1 and 2 and inserting in lieu thereof a new subsection (a), to read as follows:

"(a) To the extent that insurance does not apply or that the Attorney General may be selected to be counsel under an applicable insurance policy, the Attorney General may defend a local entity or law enforcement agency in any action in any court if:”.

And,

On page seven, section seven, subsection (b), by striking the language of subsection (b) and inserting in lieu thereof a new subsection (b), to read as follows:

"(b) If the Attorney General defends a local entity or law enforcement agency under this Code section and insurance coverage for the local entity or law enforcement agency does not exist or is denied, the state shall be liable for the expenses, costs, judgment, or settlement of the claims arising out of the representation. The Attorney General may settle or compromise any and all such claims.".
